Sexual Violence & Harassment Policy

1. Policy Statement

North View College is committed to providing a safe, respectful, and inclusive learning environment free from sexual violence, harassment, and misconduct. The College takes all reports of sexual violence seriously and ensures that individuals who disclose or report incidents are treated with dignity, sensitivity, and respect.

This policy outlines the College’s approach to prevention, reporting, investigation, and response to incidents of sexual violence involving students, whether occurring on campus or during college-sponsored activities.

2. Scope & Application

This policy applies to all students of North View College and covers incidents that occur:

  • On college premises
  • During college-sponsored events or activities
  • In situations where the behaviour impacts the college community

For the purpose of this policy, the individual reporting the incident is referred to as the Complainant, and the individual alleged to have committed the act is referred to as the Respondent.

3. Definition of Sexual Violence

Sexual violence refers to any sexual act or act targeting a person’s sexuality, gender identity, or gender expression that is committed, threatened, or attempted without consent. Such acts may be physical or psychological in nature.

Sexual violence includes, but is not limited to:

  • Sexual assault
  • Sexual harassment
  • Stalking
  • Indecent exposure
  • Voyeurism
  • Sexual exploitation

4. Consent

Consent is an active, voluntary, and ongoing agreement to engage in sexual activity. Consent cannot be obtained through force, coercion, manipulation, or when a person is incapacitated due to drugs, alcohol, or any other condition.

5. Training & Awareness

North View College provides education and awareness initiatives to promote understanding of sexual violence, consent, respectful conduct, and available support resources. A copy of this policy is included in student contracts and provided to college management and staff.

6. Reporting Sexual Violence

Students who experience or witness sexual violence are encouraged to report the incident as soon as possible. Reports may be made directly to the Campus Director or a designated College representative.

Reports can be made whether or not the Complainant chooses to pursue legal action. The College will respect the Complainant’s autonomy and confidentiality to the greatest extent possible.

7. Investigation & Response

All reports of sexual violence will be handled promptly, fairly, and impartially. The College will conduct an investigation that respects the rights of both the Complainant and the Respondent.

Interim measures may be implemented where necessary to ensure safety and well-being. Outcomes may include disciplinary actions consistent with College policies, up to and including suspension or expulsion.

8. Support Services

The College will assist Complainants by providing information about available internal and external support services, including counseling, medical services, and community resources.

9. Confidentiality & Privacy

Information related to reports of sexual violence will be handled with sensitivity and shared only on a need-to-know basis or as required by law. Records will be maintained securely in accordance with applicable privacy legislation.

10. Retaliation

Retaliation against any individual who reports sexual violence or participates in an investigation is strictly prohibited and may result in disciplinary action.

11. Policy Review

This policy is reviewed periodically to ensure compliance with legislative requirements and best practices, including those under the Ontario Career Colleges Act, 2005.
